Terms of service

The terms that apply when you use the Hymalayas app, including subscriptions, cancellation and refunds.

Last updated:

These Terms of Service (“Terms”) govern your use of the Hymalayas mobile application (“App”) provided by Superidea Reyaz, a sole proprietorship (enkeltpersonforetak), organisation number 927199785, registered at Vangberg 2a, Tromsø, Norway (“Superidea”, “we”, “us”, “our”). By downloading, accessing, or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years old to use the App, or have verifiable consent from a parent or legal guardian. By using the App you represent that you meet this requirement.

2. Your Account

The App uses Sign in with Apple or Google for authentication. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us at support@superidea.no if you suspect unauthorised use.

3. Licence to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, strictly for your personal, non-commercial use, subject to these Terms and the Apple App Store's standard EULA (apple.com/legal/internet-services/itunes/dev/stdeula).

4. Subscriptions, Billing & Cancellation

Certain features require a paid subscription (“Premium”). The following applies to all Premium subscriptions:

EU/EEA Right of Withdrawal

If you are a consumer in the EU/EEA, you normally have 14 days to withdraw from a digital purchase. By starting to use Premium features immediately after purchase, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once access has been granted. If you do not start using Premium, contact Apple for a refund within 14 days.

5. Your Content (Journal Entries & Personal Data)

You retain full ownership of everything you write in the App, including journal entries and mood logs (“Your Content”). You grant us a limited, non-exclusive licence to store and process Your Content solely to provide the App to you, sync it across your devices, and run features you explicitly use (such as reward tracking).

Sentiment analysis of your journal entries runs entirely on your device using Apple's Natural Language framework. Your journal text is not sent to Superidea's servers for analysis.

How we handle your data is described in our Privacy Policy.

6. Acceptable Use

You agree not to:

We may suspend or terminate your account for breach of these rules.

7. Intellectual Property

All content in the App, including guided meditations, audio tracks, music, visual artwork, icons, illustrations, typography, the Hymalayas name and logo, and the underlying software, is owned by Superidea or its licensors and is protected by copyright and trademark laws. Nothing in these Terms transfers any ownership to you.

8. Health & Wellness Disclaimer

Hymalayas is a wellness and meditation app. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. Content in the App is for general informational and self-care purposes only.

By using the App, you accept full responsibility for how you use its content and waive any claim against Superidea for consequences arising from ordinary use, to the fullest extent permitted by applicable law.

9. Third-Party Services

The App integrates with third-party services to function:

Your use of these services is also governed by their terms and privacy policies. We are not responsible for the practices of third-party providers.

10. Changes to the App

We may modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable to you or any third party for such changes.

11. Termination

You may stop using the App at any time by deleting it from your device and, if you wish, requesting account deletion at support@superidea.no. We may suspend or terminate your access to the App if you breach these Terms or if we reasonably believe your use poses a risk to the service or to other users. Sections intended to survive termination (including sections 5–8, 12, 13, 15) will continue to apply.

12. Disclaimers

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or meet your expectations.

Nothing in these Terms limits or excludes any rights you have as a consumer under mandatory Norwegian or EU consumer law, including under the Consumer Purchase Act (forbrukerkjøpsloven) and the Marketing Control Act (markedsføringsloven).

13. Limitation of Liability

To the maximum extent permitted by applicable law, Superidea's total aggregate liability to you for any claim arising out of or relating to the App or these Terms shall not exceed the greater of (a) the amount you paid to Apple for the App in the 12 months preceding the claim, or (b) NOK 500.

We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or loss of goodwill, even if advised of the possibility.

Nothing in this clause limits liability that cannot be limited under Norwegian law, including liability for gross negligence, intentional misconduct, or personal injury.

14. Indemnity

You agree to indemnify and hold harmless Superidea from any third-party claims, damages, or costs arising out of your breach of these Terms or your misuse of the App, to the extent permitted by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the current version. For material changes we will notify you through the App or by email at least 30 days before the changes take effect. Continued use of the App after the effective date constitutes acceptance.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of Norway, excluding its conflict-of-laws rules. Disputes between Superidea and a business user shall be brought before Oslo tingrett as exclusive venue.

If you are a consumer resident in the EU/EEA, you retain the right to bring proceedings in the courts of your country of residence, and mandatory consumer protections of your country apply.

Consumers in the EU may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

In Norway, consumer complaints may be directed to Forbrukertilsynet (forbrukertilsynet.no).
